BY REGISTERING, ACCESSING, BROWSING, OR USING ANY FEATURE OF THE PLATFORM, YOU ACKNOWLEDGE THAT YOU HAVE READ, UNDERSTOOD, AND AGREE TO BE LEGALLY BOUND BY THESE TERMS. IF YOU DO NOT AGREE, PLEASE DISCONTINUE USE OF THE PLATFORM IMMEDIATELY.
1. INTRODUCTION AND OVERVIEW
Welcome to Hutweo, a digital property discovery marketplace operated by Hutweo Solutions (βHutweoβ, “We”, “Us”, or “Our”). Hutweo provides an online platform (“Platform”) accessible via our website, mobile application, and related digital services that enables property owners and managers to list residential and commercial properties, and allows prospective tenants, buyers, and users to discover such listings and access property owner contact information. These Terms & Conditions (“Terms”, “Agreement”) constitute a legally binding contract between you (“User”, “You”, “Your”) and Hutweo Solutions governing your access to and use of the Platform and all services, features, content, and products offered through it. By using the Platform, you represent that:Β
- You have read and understood these Terms in their entirety;Β
- You have the legal capacity to enter into a binding agreement;Β
- You will comply with these Terms and all applicable laws and regulations;Β
- You are at least 18 years of age or the legal age of majority in your jurisdiction.
These Terms should be read in conjunction with our Privacy Policy, Cookie Policy, Refund Policy, and any other supplementary policies or guidelines published on the Platform, all of which are incorporated herein by reference.
2. DEFINITIONS AND INTERPRETATION
For the purposes of these Terms, the following definitions apply:

“Platform” | The Hutweo website, mobile application, and all related digital services operated by Hutweo Solutions. |
“User” | Any individual or entity who accesses or uses the Platform, including Registered Users, Property Listers, and visitors. |
“Lister” / “Owner” | A User who lists one or more properties on the Platform for the purpose of advertising availability. |
“Seeker” | A User who accesses the Platform to discover property listings and/or unlock contact information. |
“Listing” | A property advertisement published on the Platform by a Lister, containing property details, photographs, and contact information. |
“Contact Unlock” | The act of a Seeker consuming one unit of their allocated usage to access the contact details of a Lister. |
“Subscription Plan” | A paid or free-tier service plan that grants the User a defined number of Contact Unlocks within a specified validity period. |
“Services” | All features, tools, content, and functionality offered via the Platform, including listing creation, search, contact unlock, and account management. |
“Content” | All text, images, videos, data, and other materials uploaded, submitted, or otherwise made available on the Platform by Users or Hutweo. |
“Applicable Law” | All laws, regulations, rules, and orders of any government or regulatory authority applicable in India, including but not limited to the IT Act and Consumer Protection Act. |
3. NATURE OF PLATFORM AND SERVICES
3.1 Platform Classification
Hutweo is a technology-enabled digital marketplace and information discovery platform. Hutweo operates solely as an intermediary that connects property Listers with property Seekers by facilitating the discovery of property listings and the access of associated contact information.Β
Hutweo is expressly NOT and shall NOT be construed as:Β
- A real estate agent, broker, or consultant as defined under the Real Estate (Regulation and Development) Act, 2016 (RERA) or any other applicable legislation;Β
- A property manager, custodian, or administrator of any listed property;Β
- A party to any rental, lease, sale, or any other property transaction;Β
- A guarantor, underwriter, or insurer of any transaction or communication between Users;Β
- A financial institution or lender.
3.2 Scope of Services
The Platform provides the following core services:Β
Property Listing Publication: Enabling Listers to create and publish property advertisements;Β
Search & Discovery: Enabling Seekers to browse, filter, and discover property listings;Β
Contact Unlock Service: Enabling Seekers to access Lister contact information upon consumption of applicable unlock credits;Β
Account Management: Providing tools for Users to manage their profiles, subscriptions, and activity history;Β
Basic Verification Facilitation: Conducting limited document-based checks on Listers (see Section 8)
3.3 Limitations of Service
Hutweo does NOT:Β
- Own, manage, operate, or control any property listed on the Platform;Β
- Participate in, facilitate, or mediate any rental or purchase transaction;Β
- Guarantee owner responsiveness or property availability;Β
- Monitor, record, or control communications between Listers and Seekers outside the Platform;Β
- Provide legal, financial, or investment advice.
The Hutweo Platform is a discovery and information-access service. All rental, lease, or purchase decisions are made solely between Listers and Seekers. Hutweo bears no responsibility for outcomes of such interactions.
4. USER ELIGIBILITY AND REGISTRATION
4.1 Eligibility Requirements
To access and use the Platform, you must satisfy the following eligibility criteria:Β
- Age: You must be at least 18 years of age or above. By using the Platform, you represent and warrant that you meet this requirement. If you are below 18, you are prohibited from registering or using the Platform.Β
- Legal Capacity: You must have full legal capacity to enter into a binding contract under applicable Indian law.Β
- Accurate Information: You must provide truthful, accurate, current, and complete information during registration and at all times thereafter.Β
- Not Previously Suspended: You must not have been previously suspended, banned, or removed from the Platform by Hutweo for any policy violation.Β
- Compliance: You must be capable of complying with these Terms and all applicable laws and regulations.
4.2 Account Registration
To access certain features of the Platform, you must create a registered account. When registering, you agree to:Β
- Provide accurate, truthful, and complete registration information;Β
- Maintain and promptly update your account information;Β
- Keep your account credentials (username, password) confidential and secure;Β
- Notify Hutweo immediately at hutweo@gmail.com of any unauthorised use of your account;Β
- Accept responsibility for all activities that occur under your account.
4.3 Account Security
You are solely responsible for maintaining the confidentiality of your login credentials and for all activities conducted through your account, whether or not authorized by you. Hutweo shall not be liable for any loss or damage arising from unauthorized use of your account due to your failure to safeguard your credentials.
4.4 Corporate or Business Users
If you are registering on behalf of a legal entity (company, firm, trust, etc.), you represent and warrant that you have the authority to bind that entity to these Terms, and “you” shall refer to both you individually and that entity
5. CONTACT UNLOCK SERVICE β CORE BUSINESS MODEL
5.1 Service Description
The Contact Unlock Service is the primary commercial service offered by Hutweo. This service allows Seekers to access the private contact details of a Lister (such as phone number, email address, or WhatsApp contact) for a specific property listing by consuming one unit of their allocated Contact Unlock credits.
5.2 Subscription Plans
Hutweo offers the following categories of subscription plans:

Plans, pricing, quotas, and validity periods are subject to change. The current plans and pricing are displayed on the Platform at the time of purchase.
5.3 Service Consumption and Delivery
The following rules govern the consumption of Contact Unlock credits:Β
- One (1) Contact Unlock credit is consumed each time a Seeker views or reveals the contact details of a Lister on any listing;Β
- Unlocks are shared across all listings β there is no listing-specific unlock allocation.Β
- Unused credits do not carry forward beyond the validity period of the subscription plan, unless expressly stated otherwise.
- Contact Unlock credits are non-transferable between accounts.Β
- Re-unlocking the same contact within the same session may or may not consume an additional credit, depending on Platform settings at the time.
SERVICE DELIVERY RULE: The Contact Unlock Service is deemed FULLY DELIVERED and CONSUMED theΒ moment contact details are revealed to the Seeker on-screen, regardless of:Β
- Whether the Lister responds to the Seeker; β’ Whether the property is still available;Β
- Whether any agreement or transaction is concluded;Β
- Whether the Seeker is satisfied with the outcome.Β
Hutweo sells access to information, not outcomes
5.4 No Guarantee of Outcomes
Hutweo expressly does not guarantee:Β
- That the Lister will respond to the Seeker’s communication;Β
- That the property advertised will be available or match the description;Β
- That any rental, lease, or transaction will be successfully concluded;Β
- The accuracy, completeness, or legality of any Listing;Β
- The identity, ownership status, or authority of any Lister.
6. PROPERTY LISTINGS β RULES AND OBLIGATIONS
6.1 Who May List
During Phase 1 of the Platform’s operation, only direct property owners may create and publish Listings. Property managers, brokers, and agents are not permitted to list on behalf of third parties unless Hutweo explicitly authorizes such arrangements in writing. This policy may be revised in future phases of the Platform.
6.2 Listing Rules
By publishing a Listing, the Lister agrees to and represents the following:Β
- Ownership: You are the legal owner of the property or have the legal authority to advertise it;Β
- Accuracy: All information in the Listing, including property type, size, location, amenities, photographs, and rent/price, is accurate, complete, and not misleading;Β
- One Listing per Property: Only one active Listing per property is permitted. Duplicate Listings for the same property will be removed.Β
- Availability: The property is genuinely available for rent at the time of listing.Β
- Legality: The property and its proposed use comply with all applicable laws, local regulations, and municipal rules;Β
- Non-Commercial Use: Listings are for genuine, non-commercial property advertising purposes only;Β
- Photographs: All photographs uploaded are authentic and accurately represent the property.
6.3 Prohibited Listings
The following categories of Listings are strictly prohibited:Β
- Listings for properties you do not own or do not have authority to advertise;Β
- Duplicate Listings for the same property under different descriptions;Β
- Listings containing false, fabricated, or materially misleading information;Β
- Listings for illegal purposes or properties in violation of applicable laws;Β
- Listings designed to scam, defraud, or deceive Seekers;Β
- Listings with doctored, stock, or misrepresentative photographs;Β
- Listings for properties subject to legal disputes, encumbrances, or court orders that affect the ability to rent or sell.
6.4 Hutweo’s Rights Over Listings
Hutweo reserves the right, at its sole discretion and without prior notice, to:Β
- Remove, suspend, or modify any Listing that violates these Terms or any applicable law;Β
- Limit the number of active Listings per User account.Β
- Request additional documentation or evidence of ownership before publishing or reinstating a Listing;Β
- Mark Listings as “Unverified” pending document submission;Β
- Permanently ban Users who repeatedly submit false or misleading Listings.
Hutweo shall not be liable to the Lister or any third party for the removal, suspension, or modification of any Listing pursuant to this Section.
7. LISTING VERIFICATION AND DISCLAIMER
7.1 Scope of Verification
Hutweo may, at its sole discretion, conduct a basic verification process for certain Listings or Listers. This process may include:Β
- Requesting copies of government-issued identity documents (e.g., Aadhaar, PAN, Passport, etc);Β
- Requesting property ownership documents (e.g., sale deed, tax receipts, khata certificate, etc.);Β
- Conducting brief video verification calls with the Lister;Β
- Conducting reverse address checks or cross-referencing with public records where feasible.
7.2 Verification Disclaimer
IMPORTANT: The verification process conducted by Hutweo is LIMITED, ADMINISTRATIVE, and NON-EXHAUSTIVE. Verification by Hutweo does NOT constitute:
- Legal confirmation of property ownership or title;Β
- Confirmation of the property’s compliance with local regulations or building laws;Β
- A guarantee of the authenticity or accuracy of documents submitted by the Lister;Β
- An endorsement or recommendation of the Listing or the Lister;Β
- Any form of due diligence sufficient to replace an independent legal or financial inquiry.
Users are strongly advised to independently verify the identity of the Lister, the ownership status of the property, the physical condition of the property, and all terms of any proposed transaction before committing to any rental agreement.
7.3 No Liability for Verification Failures
Hutweo shall not be held liable for any loss, damage, or harm arising from reliance on any verified or unverified Listing, including but not limited to fraudulent Listings that passed verification checks. Independent due diligence by Users remains their sole responsibility.
8. PAYMENTS, SUBSCRIPTIONS, AND REFUND POLICY
8.1 Payment Processing
All payments on the Platform are processed through third-party payment gateway providers, including but not limited to Razorpay, PayU, or other authorized payment processors (“Payment Processors”). By making a payment on the Platform, you agree to abide by the terms and conditions of the applicable Payment Processor in addition to these Terms.Β
Hutweo does NOT:Β
- Store, retain, or have access to your complete payment card details, bank account information, or other sensitive financial data;Β
- Assume liability for any errors, failures, delays, or unauthorised transactions on the part of the Payment Processor;Β
- Process international payments unless expressly stated otherwise.
8.2 Pricing and Taxes
All prices displayed on the Platform are in Indian Rupees (INR) and are inclusive of applicable taxes unless stated otherwise. Hutweo reserves the right to revise pricing, subscription structures, and plan features at any time. Such changes shall be published on the Platform and shall not affect existing active subscriptions unless the User is expressly notified.
8.3 Subscription Activation
A subscription plan is activated upon successful confirmation of payment by the Payment Processor. Hutweo is not responsible for delays in activation caused by third-party payment processing failures, banking intermediaries, or technical issues beyond Hutweo’s control.
8.4 Refund Policy
Hutweo’s refund policy is strictly governed by the following rules:
8.4.1 Eligible for Refund: A refund request may be considered and approved in the following circumstances:Β
- No Contact Unlock Consumed: The User purchased a subscription plan but has not unlocked any contact details within 7 days of purchase;Β
- Duplicate Payment: The same transaction was charged more than once due to a technical error.
- Technical Failure: A confirmed technical failure on the Hutweo Platform prevented the User from accessing any service, verified and acknowledged by Hutweo’s technical team.Β
- Unauthorised Transaction: A payment was made without the User’s authorisation, subject to verification, User’s FIR or bank complaint, and Hutweo’s investigation.
8.4.2 NOT Eligible for Refund: A refund shall NOT be provided in the following circumstances:Β
- Any Contact Unlock has been consumed, even partially (one unlock = full service delivery);Β
- Dissatisfaction with the property, the Lister’s response, or the outcome of a transaction;Β
- The property was found to be unavailable, inaccurately described, or unsuitable after contact.Β
- Change of mind by the User after subscription purchase; β’ Failure of any transaction or negotiation;Β
- The User violated any of the Terms of Hutweo, leading to account suspension.
CORE REFUND PRINCIPLE: Service is deemed fully and irrevocably delivered upon the first Contact Unlock. Even one unlock bars all refund eligibility. This policy reflects the nature of the information-access service β the information itself is the product.
8.5 Refund Process
To request a refund, Users must:Β
- Submit a written refund request to hutweo@gmail.com within 7 (seven) calendar days of the date of the transaction;Β
- Provide the registered email address, Transaction ID, date of purchase, and share a screenshot as proof of payment, along with a detailed reason for the refund.;Β
- Cooperate with any investigation or verification process conducted by Hutweo.Β
Hutweo will process eligible refund requests within 7-10 business days of verification. Refunds shall be credited to the original payment method. Hutweo reserves the right to refuse refund requests that do not meet the eligibility criteria.
9. USER RESPONSIBILITIES AND CODE OF CONDUCT
9.1 General Obligations
All Users of the Platform agree to:Β
- Use the Platform in good faith and exclusively for lawful purposes;Β
- Provide truthful, accurate, and non-misleading information in all interactions on the Platform;Β
- Respect the rights, privacy, and dignity of other Users;Β
- Comply with all applicable laws, regulations, and local ordinances;Β
- Promptly notify Hutweo of any suspected fraudulent activity, scams, or policy violations discovered on the Platform.
9.2 Seeker-Specific Obligations
Seekers specifically agree to:Β
- Use contact information obtained through the Platform solely for the purpose of property inquiry;Β
- Not misuse, sell, share, or commercially exploit contact information unlocked via the Platform;Β
- Verify all property details independently before entering into any agreement.Β
- Not engage in harassment, abuse, intimidation, or threatening behaviour toward Listers.
9.3 Lister-Specific Obligations
Listers specifically agree to:Β
- Ensure all Listing information is accurate, current, and updated promptly when changes occur.Β
- Remove or deactivate Listings as soon as a property is no longer available.Β
- Respond to genuine Seeker inquiries in good faith;Β
- Do not list the same property multiple times to gain unfair visibility on the Platform.
10. PROHIBITED ACTIVITIES
The following activities are expressly prohibited on the Platform and may result in immediate account suspension, permanent ban, and/or legal action:
10.1 Fraudulent and Deceptive Conduct
- Creating fake, false, or misleading property listings;Β
- Impersonating another individual, property owner, or Hutweo representative;Β
- Submitting forged, fabricated, or altered documents for verification;Β
- Collecting advance rent, deposits, or fees from Seekers for properties you do not own or control;Β
- Using the Platform to conduct any form of real estate fraud or scam.
10.2 Technical Misuse
- Using automated bots, crawlers, scrapers, or other automated tools to access the Platform or extract data;Β
- Attempting to reverse-engineer, decompile, or circumvent any security or access control mechanism;Β
- Accessing areas of the Platform or data that you are not authorized to access;Β
- Uploading viruses, malware, or any malicious code that could disrupt Platform operations;Β
- Conducting denial-of-service attacks or otherwise interfering with Platform availability.
10.3 Data and Privacy Violations
- Collecting, harvesting, or scraping personal information of other Users;Β
- Using contact information obtained through the Platform for commercial solicitation, spam, or unsolicited marketing;Β
- Sharing or selling contact details of Listers or Seekers to third parties;Β
- Recording phone or video conversations without the consent of all parties, where consent is legally required.
10.4 Abusive Conduct
- Engaging in harassment, abuse, threatening, defamatory, or hateful communication toward any User;Β
- Discriminating against Users on the basis of religion, caste, gender, race, disability, or any other protected characteristic;Β
- Publishing or sharing obscene, pornographic, or sexually explicit content on the Platform.
11. INTERMEDIARY STATUS AND LIABILITY
11.1 Status Under Information Technology Act
Hutweo operates as an “intermediary” as defined under Section 2(1)(w) of the Information Technology Act, 2000 (as amended) and the Information Technology (Intermediary Guidelines and Digital Media Ethics Code) Rules, 2021. As an intermediary, Hutweo provides a platform for third-party-generated content (property listings) and is not the originator or primary publisher of such content.
11.2 No Liability for User-Generated Content
Hutweo does not monitor, pre-screen, or endorse User-generated content published on the Platform. Hutweo is not liable for:Β
- The accuracy, completeness, or legality of any property Listing;Β
- Any false or misleading representations made by Listers;Β
- Any actions, omissions, or representations of any User on or off the Platform;Β
- Any disputes arising between Listers and Seekers;Β
- The outcome of any property transaction, negotiation, or communication.
11.3 Safe Harbour
Hutweo’s liability protection as an intermediary is conditional upon Hutweo acting expeditiously to remove or disable access to unlawful content upon receiving actual knowledge or a court order directing such removal, in accordance with applicable law.
12. LIMITATION OF LIABILITY
12.1 General Limitation
To the maximum extent permitted by applicable law, Hutweo, its directors, officers, employees, agents, affiliates, and licensors shall not be liable for any:Β
- Indirect, incidental, special, consequential, exemplary, or punitive damages;Β
- Loss of profits, revenue, data, goodwill, or business opportunities;Β
- Physical property damage or personal injury arising from property visits;Β
- Fraudulent or unauthorised acts by other users;Β
- Failure of any third-party service, payment processor, or communication channel.
12.2 Maximum Aggregate Liability
In all cases, Hutweo’s maximum aggregate liability to any User for any claim arising out of or related to these Terms or the use of the Platform shall be strictly limited to the amount actually paid by that User to Hutweo in the three (3) months immediately preceding the event giving rise to the claim.
12.3 Essential Basis
The limitations and exclusions of liability set forth in this Section reflect a fair allocation of risk between Hutweo and Users, and form an essential basis of the bargain between the parties. Hutweo would not be able to provide the Platform at current pricing without these limitations.
12.4 Consumer Rights
Nothing in these Terms shall exclude or limit any liability that cannot be excluded or limited under applicable Indian law, including rights under the Consumer Protection Act, 2019.
13. INDEMNIFICATION
You agree to indemnify, defend, and hold harmless Hutweo Solutions, its officers, directors, employees, agents, successors, and assigns from and against any and all claims, demands, suits, proceedings, losses, liabilities, damages, costs, and expenses (including reasonable legal fees and court costs) arising out of or related to:Β
- Your access to or use of the Platform; β’ Any Listing you publish or any content you submit on the Platform;Β
- Your violation of these Terms or any applicable law or regulation;Β
- Your infringement of any third party’s intellectual property, privacy, or other rights;Β
- Any misrepresentation made by you to another User or to Hutweo;Β
- Any dispute between you and another User arising from interactions on or off the Platform;Β
- Any damage to property or personal injury caused during a property visit arranged through the Platform.
Hutweo reserves the right to assume exclusive defence and control of any matter subject to indemnification by you, in which case you agree to cooperate with Hutweo’s defence of such claim.
14. INTELLECTUAL PROPERTY RIGHTS
14.1 Hutweo’s Intellectual Property
All intellectual property on the Platform – including but not limited to the Hutweo brand name, logo, trademarks, trade dress, website design, user interface, software code, algorithms, databases, and proprietary content – is owned by or licensed to Hutweo Solutions and is protected under applicable Indian intellectual property laws, including the Trade Marks Act, 1999 and the Copyright Act, 1957.Β
Users are granted a limited, non-exclusive, non-transferable, revocable license to access and use the Platform strictly for its intended purpose in accordance with these Terms. No other rights are granted.
14.2 User-Generated Content License
By uploading or submitting any content (including photographs, descriptions, and contact information) to the Platform, you grant Hutweo a non-exclusive, worldwide, royalty-free, sublicensable license to use, reproduce, modify, display, and distribute such content for the purpose of operating, promoting, and improving the Platform.
14.3 Prohibited Use of Hutweo IP
You may NOT:Β
- Copy, reproduce, distribute, or create derivative works from any Hutweo-owned content;Β
- Use the Hutweo name, logo, or trademarks without prior written consent;Β
- Scrape or extract data from the Platform for commercial use or competitive intelligence;Β
- Represent yourself as being affiliated with or endorsed by Hutweo.
15. THIRD-PARTY COMMUNICATION CHANNELS
15.1 Communication Methods
Upon unlocking contact details, Seekers and Listers may communicate via the following channels:Β
- Direct telephone calls;Β
- WhatsApp messaging;Β
- Email (if provided by the Lister);
- Any other contact method mutually agreed upon by the parties.
15.2 Hutweo’s Role in Communication
Hutweo does NOT:Β
- Monitor, access, record, or control any communication between Seekers and Listers;Β
- Mediate or intervene in disputes arising from such communications;Β
- Guarantee the safety, reliability, or legality of off-platform communications.
15.3 Communication Safety
Users are advised to exercise caution when communicating with unknown parties. Hutweo recommends:Β
- Conducting initial communication via text/WhatsApp before sharing personal details;Β
- Visiting properties only with a trusted company;Β
- Not making advance payments to Listers without physical verification of the property;Β
- Reporting suspicious communication toΒ hutweo@gmail.comΒ immediately.
16. PRIVACY AND DATA PROTECTION
Hutweo is committed to protecting your personal information in accordance with the Information Technology (Amendment) Act, 2008, the Information Technology (Reasonable Security Practices and Procedures and Sensitive Personal Data or Information) Rules, 2011, and the Digital Personal Data Protection Act, 2023 (to the extent in force).Β
Our Privacy Policy, which is incorporated into these Terms by reference, sets out in detail:Β
- What personal data we collect and how;Β
- How we use, store, and protect your personal data;Β
- Your rights regarding your personal data;Β
- How we handle data sharing with third-party service providers.Β
By using the Platform, you consent to the collection and use of your personal data in accordance with our Privacy Policy.
17. PLATFORM AVAILABILITY AND DISCLAIMER OF WARRANTIES
17.1 Availability
Hutweo endeavors to maintain Platform availability on a 24/7 basis; however, we do not guarantee uninterrupted, error-free, or secure access to the Platform. The Platform may be temporarily unavailable due to scheduled maintenance, upgrades, or circumstances beyond our control.
17.2 Disclaimer of Warranties
To the fullest extent permitted by law, the platform and all services are provided on an “as is” and “as available” basis without warranties of any kind, express or implied, including but not limited to:Β
- Warranties of merchantability or fitness for a particular purpose;Β
- Warranties that the platform will meet your specific requirements;Β
- Warranties of accuracy, completeness, or reliability of any content;Β
- Warranties that the platform is free from errors, bugs, or security vulnerabilities.
18. ACCOUNT SUSPENSION AND TERMINATION
18.1 Termination by Hutweo
Hutweo reserves the right to suspend, restrict, or permanently terminate your account and access to the Platform at any time, with or without prior notice, for any of the following reasons:Β
- Violation of any provision of these Terms;Β
- Submission of fraudulent, false, or misleading content;Β
- Engaging in abusive, harassing, or threatening conduct toward other Users;Β
- Suspected involvement in fraudulent property schemes or scams;Β
- Legal obligation or court order requiring such action;Β
- Protection of the safety and interests of other Users or the Platform.
18.2 Consequences of Termination
Upon termination:Β
- All active Listings associated with your account will be removed;Β
- Any unused Contact Unlock credits will be forfeited (subject to the Refund Policy);Β
- Your access to the Platform and all associated data will be revoked;Β
- Any ongoing obligations under these Terms (including indemnification and liability) shall survive termination.
18.3 Termination by User
Users may terminate their account at any time by submitting a written request toΒ hutweo@gmail.com. Termination does not entitle the User to a refund of any paid subscription amounts, except as provided under Section 8.4.
19. FORCE MAJEURE
Hutweo shall not be held liable for any delay, disruption, or failure in the provision of the Platform or Services arising from events beyond Hutweo’s reasonable control, including but not limited to:Β
- Acts of God, natural disasters, floods, earthquakes, or pandemics;Β
- Acts of war, terrorism, civil unrest, or governmental actions;Β
- Internet outages, telecommunications failures, or infrastructure disruptions;Β
- Power outages, cyberattacks, or data center failures;Β
- Changes in applicable law or regulatory requirements that affect Platform operations.Β
In such events, Hutweo shall notify Users as soon as reasonably practicable and shall endeavor to restore Services within a reasonable time.
20. GOVERNING LAW AND DISPUTE RESOLUTION
20.1 Governing Law
These Terms and any dispute, controversy, or claim arising out of or in connection with them shall be governed by and construed in accordance with the laws of the Republic of India, without regard to its conflict of law principles.
20.2 Informal Resolution
Before initiating formal legal proceedings, the parties agree to attempt to resolve any dispute through good-faith negotiation and mutual discussion. A party wishing to raise a dispute shall notify the other in writing (via email toΒ hutweo@gmail.com), describing the nature of the dispute and the relief sought. The parties shall then attempt to resolve the matter within thirty (30) days of such notice.
20.3 Arbitration
If informal resolution is unsuccessful, the dispute shall be finally settled by binding arbitration conducted in accordance with the Arbitration and Conciliation Act, 1996 (as amended). The following rules shall apply:Β
- The arbitration shall be conducted by a sole arbitrator mutually appointed by both parties;Β
- If the parties fail to agree on an arbitrator within 30 days, the arbitrator shall be appointed in accordance with the procedure under the Arbitration and Conciliation Act, 1996;Β
- The seat and venue of arbitration shall be Kochi, Kerala, India;Β
- The language of arbitration shall be English;Β
- The award shall be final and binding on both parties.
20.4 Jurisdiction
Subject to the arbitration clause above, the courts of Kochi, Kerala, India shall have exclusive jurisdiction over any legal proceedings between the parties. By using the Platform, you consent to the personal jurisdiction of such courts.
20.5 Class Action Waiver
Users agree that any dispute resolution proceedings shall be conducted on an individual basis. You waive any right to participate in class action lawsuits or class-wide arbitration against Hutweo to the fullest extent permitted by applicable law.
21. MODIFICATIONS TO TERMS AND PLATFORM
21.1 Modifications to Terms
Hutweo reserves the right to amend, revise, or replace these Terms at any time at its sole discretion. The revised Terms will be published on the Platform with an updated “Last Updated” date. For material changes, Hutweo will endeavor to provide advance notice via email or an in-Platform notification.Β
Your continued use of the Platform after the publication of revised Terms constitutes your acceptance of the updated Terms. If you do not agree to the revised Terms, you must cease using the Platform immediately.
21.2 Modifications to Platform
Hutweo may modify, discontinue, add, or remove features of the Platform at any time. Hutweo shall not be liable to you or any third party for any such modifications, discontinuations, or changes in features.
22. GENERAL PROVISIONS
22.1 Entire Agreement
These Terms, together with the Privacy Policy and any other policies incorporated herein, constitute the entire agreement between you and Hutweo with respect to the Platform and supersede all prior agreements, representations, and understandings.
22.2 Severability
If any provision of these Terms is found to be invalid, illegal, or unenforceable by a court of competent jurisdiction, such provision shall be modified to the minimum extent necessary to make it enforceable, and the remaining provisions shall continue in full force and effect.
22.3 Waiver
Hutweo’s failure to enforce any right or provision of these Terms shall not constitute a waiver of such right or provision. A waiver of any right shall only be effective if made in writing and signed by an authorized representative of Hutweo.
22.4 Assignment
You may not assign or transfer your rights or obligations under these Terms without Hutweo’s prior written consent. Hutweo may freely assign its rights and obligations, including in connection with a merger, acquisition, or sale of assets.
22.5 Notices
All notices to Hutweo under these Terms must be sent in writing toΒ hutweo@gmail.com. Hutweo may send notices to you via the email address associated with your registered account or via in-Platform notifications.
22.6 Language
These Terms are drafted in English. In the event of any conflict between an English version and a translated version of these Terms, the English version shall prevail.

23.3 Reporting Fraud or Abuse
If you become aware of a fraudulent Listing, abusive User, or any other conduct that violates these Terms or applicable law, please report it immediately toΒ hutweo@gmail.com with the subject line “URGENT: Fraud/Abuse Report” and include as much detail as possible, including Listing IDs, screenshots, and contact details of the offending party.
ACKNOWLEDGEMENT OF TERMS
By accessing, registering on, or using the Hutweo Platform, you acknowledge that:Β
- You have read these Terms & Conditions in their entirety;Β
- You understand and agree to be legally bound by them;Β
- You are at least 18 years of age and legally competent to enter into this agreement;Β
- You accept the limitations of liability and the nature of the contact unlock service as described herein.
If you do not agree with any part of these Terms, you must immediately discontinue use of the Platform.
